Kaohsiung mayor criticizes KMT’s legislative proposal

TAIPEI (TVBS News) — Amid controversy over the proposed amendments to the Law Governing the Legislative Yuan's Power, Kaohsiung Mayor Chen Chi-mai (陳其邁) criticized the Kuomintang's (KMT, 國民黨) version on Thursday (May 23), claiming it potentially violates the constitution. Chen argued that the KMT's draft includes penalties that could infringe upon criminal law, exceeding the scope defined by the Constitutional Court's Interpretation No. 585, raising concerns about its constitutionality.

Constitutional Concerns and Public Discussion

Chen highlighted that the Democratic Progressive Party's (DPP, 民進黨) version adhered to Interpretation No. 585, ensuring constitutional compliance. However, he pointed out that the KMT's proposal fails to exclude independent institutions and executive privileges from the Legislative Yuan's investigative powers, violating the spirit of Interpretation No. 585. Chen emphasized the importance of public and thorough discussions on the bill, which involves the administrative, legislative, and judicial branches, as well as public rights, to uphold procedural justice and gain public support.

The Need for Transparency and Consensus

Chen expressed concern over the lack of substantial discussion within the committee on the KMT's version, especially amid leaks of national defense and diplomatic secrets by legislators.

Chen recalled that the version proposed by DPP legislator Yu Mei-nu (尤美女) complied with Interpretation No. 585 by imposing administrative fines for violations, contrasting with the current KMT version's approach. Chen stressed the necessity of open and comprehensive debates before voting on the bill to resolve public doubts and embody the constitutional principle of sovereignty residing with the people.
